North Carolina Attorney General Roy Cooper recently declared that a foreclosure rescue outfit, working out of two North Carolina cities, and said owner have been permanently banned from conducting foreclosure assistance work in the state.
Cooper has cracked down on foreclosure fraud in the past five years, putting the skids on twelve supposed foreclosure rescue companies with help from the state's Consumer Protection Division. All twelve were brought to court and in excess of $1 million in judgments were awarded, including refunds of lost money to scammed consumers. Consumer complaints regarding foreclosure schemes in the state started to rise in 2005. At that point, Cooper fought to change the law. Now, in North Carolina, it is against the law to charge in advance for foreclosure assistance or loan modifications. The latest case before the Wake County Superior Court and state attorney general involved a default judgment against Reginald Turner. Turner was doing business as Hazelton Management and the Carley Group. Turner was ordered to pay refunds of $32,804 to 24 victims and $50,000 in civil damages to local public schools. He and his companies are prohibited from ever engaging in debt relief and loan modification service in North Carolina. The attorney general says there is an easy way for consumers to avoid this type of scam. Instead of paying someone for foreclosure help, he suggests calling a toll-free hotline established by the North Carolina Commissioner of Banks' Office: 1-866-234-4857. The hotline, available from 8am until 9pm Monday through Friday and 8am to 5pm on Saturdays, is staffed by certified mortgage counselors and is free to all consumers. Cooper believes that distressed homeowners who are not getting help or advice from their lenders are turning to unscrupulous individuals and companies in desperation. Sometimes foreclosure is the only answer, but he is committed to giving struggling consumers a fighting chance to modify their loans and hopefully, stay in their homes. He is also hot on the trail of lenders in the state. The multi-state investigation is looking into foreclosure practices of major lenders.
